Interactive seminar focusing on the application of appropriate ethical standards in ten challenging contexts. The contexts focus not solely on challenges facing lawyers individually but also those facing firms as well as the legal profession at large.
The instructor leads participants through interactive analysis of what the instructor suggests may be the "top ten" challenges in the field of ethics in the 21st Century. Some of these "top ten" issues have their greatest impact on the practice of individual lawyers (whether solo or in firms) and others have their greatest impact on firms generally and/or on the legal profession at large as we progress further into the rapidly changing era of the 21st Century.

Materials: This seminar presents a series of hypothetical scenarios raising ethical/professional issues for interactive analysis focusing on lawyers individually, on law firms and on the legal profession in general.. It also includes Appendix A containing pertinent Rules of Professional Conduct, Appendix B providing insights into the historical evolution of both ethical and civil standards governing the practice of law, and Appendix C describing a recommended methodology for properly analyzing and solving ethics problems.

1.0 hour = Presentation of five hypothetical scenarios challenging the abilities of lawyers, law firms and the legal profession to properly apply ethical and civil standards applicable to lawyers, law firms and the profession.
1. First Hour:
01. Professional-responsibility issues in the context of email communications (MR Rule 1.6).
02. Professional-responsibility issues social-media on the internet (MR Rules 1.6,1.7,1.8,1.9, 1.10, 2.1).
03. Ethical-standard "floors" and civil-standard "ceilings." (Preamble [14][15][16][17][18][19]
04. Ethical romance or romantic ethics (MR Rules 1.6, 1.7, 1.8, 2.1)
05. Post-litigation ethical issues (MR Rules 3.1, 3.3, 3.4, 4.1)
1.0 hour = Presentation of five additional hypothetical scenarios challenging the abilities of lawyers, law firms and the legal profession to properly apply ethical and civil standards applicable to law firms and the profession. Analyses and interactive discussion of a series of hypothetical problems.
2. Second Hour:
06. Is there a "Goldfarb" time-bomb for ethical standards embedded in free-trade treaties?
07. Can Multidisiplinary Practices be Reconciled with Ethical Standards? (MR Rules 1.6 through 2.1)
08. Can/Should/Does the complexity of legal issues render some ethical issues "passe"?
09. Should there be a "national" bar authorizing nationwide practice? (Conflicts-of-Laws Issues)
10. Should there be an "international" bar authorizing international practice? (Conflicts-of-Laws)
