Description:
The customary concept – “ineffective assistance of counsel” – may give way to a query of effective assistance of counsel, given vehement public opposition to tax increases. Budget cuts may further reduce the importance society ascribes to providing effective assistance of counsel. This seminar explores the importance of legal ethics and the Sixth Amendment, i.e., [right to counsel] exists, and is needed, in order to protect the fundamental right to a fair trial, (Strickland v. Washington, US, 1984). Interesting conflict of interest issues are examined as they relate to ineffective assistance claims, a pressing issue of the times.
