Description
Justice Joseph Story argued in 1821 against a trend toward elective judiciaries. Nearly a century later Roscoe Pound said elective judiciaries were undermining judicial legitimacy. Yet, in 39 states judges are still elected. What does this suggest to the public about the ethics of the court and by extension, to lawyers as officers of the court? Special attention is devoted to issues with elections of judges, particularly in light of the seminal Caperton v. A. T. Massey (US, 2009).
